Women Paying Alimony & Spousal Support on the Rise

Updated: Oct 17, 2022

I read an interesting article recently talking about a new trend in alimony payments. As women occupy more higher-paying positions and make more money, so too are alimony payments of females to ex-spouses.

According to the article, a survey from the American Academy of Matrimonial Lawyers (AAML) found that four in 10 lawyers (45%) have seen an increase over the past three years of women paying alimony.

Women have been responsible for paying spousal support since a 1979 Supreme Court decision that ruled alimony should be gender neutral. With demographics shifting to include many more female breadwinners, spousal support payments by women are on the rise.

The article goes on to discuss some of the nuances of stereotypes in gender roles, and how this has caused some resistance and confusion in the area of by the participants in a family law case. There is of course resistance to the idea by some who don’t understand why it is applicable to them.

The article goes on to mention the new tax law in which spousal support payments are no longer tax deductible starting in 2019. This issue is cause for good planning and legal advice when seeking divorce.
