No Fault Divorce Reform

Many people take for granted that California is a “no fault” divorce state. There are many places in the world and even other states where a divorce must be granted by a Judge.

I read an interesting article today about the move in Great Britain to move from fault oriented to no-fault divorce.  Under the existing law, per the article, a spouse had to prove fault by the other partner through adultery, desertion or unreasonable behaviour for divorce proceedings to start.

Not so long ago, divorces were mostly fault based, and the faulted party was awarded a higher share of assets.  This tended to side more heavily toward women who were “cheated” as opposed to men. 

The article touches on an important concept, which is the division of property in divorce.  The nuances and considerations are still complicated, even in a no fault divorce jurisdiction like California.  When dividing property, it is important to seek legal advice, and have a plan to do so in a way the court will agree with.
